By downloading or using WheelPower (“the app”), you accept these terms. If you do not agree, do not use the app.
1. The service
WheelPower is a cycling training app that analyzes your data, computes fitness indicators and offers personalized coaching via a virtual assistant generated by AI (Clémence), as well as session planning.
2. ⚠️ Health disclaimer
WheelPower provides sports information and recommendations for guidance only. This is not medical advice. Consult a healthcare professional before starting or changing a training program, and stop any effort in case of pain or discomfort. You train at your own risk.
3. Account
You are responsible for the accuracy of your account information and the confidentiality of your credentials. You must meet the legal age requirement in your country.
4. WheelPower Pro subscription
- Plans: paid auto-renewing subscription through the App Store: monthly at €14.99 or yearly at €149.99, each with a 14-day free trial for eligible new subscribers, then automatic renewal at the price of the chosen plan. These prices are indicative (euro area). Prices vary by country; the applicable price is the one displayed by the App Store at the time of purchase.
- Without Pro: the virtual assistant generated by AI (Clémence) is available up to 5 messages per 7-day period; the core features remain available without a subscription. The quota is tied to your email address; deleting and recreating your account during the current week does not reset it.
- With Pro: there is no limit on the number of messages you can send to the assistant. The publisher may nevertheless restrict or suspend automated or clearly abusive use (for example, requests sent by a program) to protect the service and other users.
- Auto-renewal: the subscription renews automatically at the end of each period, unless cancelled at least 24 hours before the renewal date.
- Renewal information (French Consumer Code, art. L.215-1): for a yearly subscription, a reminder is sent in the app about 30 days before the renewal date, so you can decide whether to renew.
- Manage / cancel: at any time from iOS Settings → your name → Subscriptions. Payment is charged through your Apple account.
- Refunds: handled by Apple under its terms (apple.com/legal).
- Right of withdrawal: under consumer law you generally have a 14-day withdrawal period for a subscription. By accessing the service immediately (digital content supplied without delay), you request its immediate performance and waive this right of withdrawal, to the extent permitted by law. Refunds remain handled by Apple.
- Changes to the offers: to preserve the economic balance of the service or to adapt to a technical constraint, the publisher may change the content of the offers with and without Pro (for example, assistant usage quotas). Pro subscribers are informed at least 30 days before the change takes effect, via the app's release notes ("What's New") or an in-app message, and may cancel their subscription at any time before that date at no cost if they do not accept the change.
5. Acceptable use
You agree not to misuse the app, attempt to access it in an unauthorized way, or use it for unlawful purposes.
6. Intellectual property
The app, its content and its trademarks remain the property of the publisher. No rights are granted to you beyond personal use of the app.
7. Personal data
The processing of your data is described in our Privacy Policy.
8. Limitation of liability
The app is provided “as is”. To the extent permitted by law, the publisher cannot be held liable for indirect damages resulting from use of the app, nor for the accuracy of the sports recommendations.
9. Termination
You may stop using the app and delete your account at any time. We may suspend access in the event of a breach of these terms.
10. Governing law
These terms are governed by French law. Any dispute falls under the competent courts of Paris, France, subject to the applicable consumer-protection provisions.
11. Consumer mediation
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, every consumer has the right to use a consumer mediator free of charge with a view to the amicable resolution of a dispute with the publisher. This is only possible after you have tried to settle the dispute with us directly, by a written complaint sent to contact.wheelpowerapp@gmail.com, which has remained without a satisfactory answer for more than two months.
